1. Acceptance of Terms

By accessing or using the Pictura API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Pictura API ("we," "us," or "our").

2. Description of Service

Pictura API is an AI model aggregation platform that provides access to multiple artificial intelligence models through a unified, OpenAI-compatible API endpoint. The Service includes:

• Access to image generation models (FLUX, SDXL, DreamShaper)
• Access to language models (Llama, Qwen)
• A credit-based usage system
• API key management and dashboard
• Billing and credit purchase functionality

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials and API keys
• All activities that occur under your account
• Providing accurate and complete registration information
• Promptly notifying us of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. API Usage and Rate Limits

Your use of the API is subject to the following conditions:

• API keys are personal and non-transferable
• You must not share your API key with unauthorized third parties
• We reserve the right to impose rate limits to ensure fair usage and service stability
• Excessive usage patterns that degrade service quality for other users may result in temporary throttling or suspension
• We may modify available models, endpoints, and capabilities at any time

5. Credit System and Payments

The Service operates on a credit-based system:

• New accounts receive 25 free credits upon registration
• Additional credits can be purchased through our billing system via Stripe
• Credit costs vary by model and usage type (per image for image models, per token for language models)
• All purchases are final and non-refundable unless required by applicable law
• Credits do not expire
• We reserve the right to modify credit pricing with reasonable notice
• Prices are listed in US Dollars

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You may not use the Service to:

• Generate illegal, harmful, or abusive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to reverse-engineer, decompile, or exploit the Service
• Resell or redistribute the Service without written permission
• Interfere with or disrupt the Service or its infrastructure

7. Intellectual Property

The Service, including its design, features, and documentation, is owned by Pictura API and protected by intellectual property laws. Content generated through the Service using your prompts belongs to you, subject to the terms and licenses of the underlying AI models. You grant us a limited license to process your inputs solely for the purpose of providing the Service.

8. Data Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to the data practices described therein. We do not store prompts or generated outputs beyond what is necessary to fulfill your API request.

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated outputs will be accurate, complete, or suitable for any particular purpose
• Defects will be corrected within any specific timeframe

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PICTURA API BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination:

• Your right to use the Service ceases immediately
• Unused credits may be forfeited
• Provisions that by their nature should survive termination will continue to apply

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service dashboard. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.
